AL JAMA-AH WESTERN CAPE welcomes High Court ruling on Tafelberg
The AL JAMA-AH congratulates the Reclaim the City and other role players in their victory to Stop the Sale of Tafelberg.
The Western High Court judgement against the Western Cape Government is even a bigger victory for the struggles of women calling for affordable housing and for land in the City, The High Court ruling affirms that the Province and City have a constitutional and legislative obligation to use land in Central Cape Town to address the legacy of the apartheid spatial planning.
AL JAMA-AH is elated at the court’s further ruling that the sale of Tafelberg was unlawful and should be set aside. The poor and oppressed people in the province have suffered for many years of being forced to live far away from their places of work, social amenities and access to job opportunities. We are thrilled by the court order and would like to see the Minister of Housing to be consulted as well.
We hope this ruling against the DA-run Province will serve as lessons in other parts of the province and country. The Constitution protects all citizens and they should have a right to the best areas of this City. AL JAMA-AH calls on the DA to stop making “this City works for you” along racial enclaves and to fully transform its spatial planning. Such ruling should also apply to evictions.
