<p><strong>COMMENT: SUPERIOR COURTS BILL 2010 (Deadline 30 June 2010)</strong></p>
<p>The  Al JAMA-AH  Political Party takes this opportunity to congratulate you and wish you strength when you will soon introduce the “Superior Courts Bill” in the General Assembly of the Parliament of South Africa. We would like to take up your invitation to comment on the Bill. We  now bring to your attention our concern that no provision is made to include a <strong>SPECIALIST COURT</strong> to deal with justiciable matters relating to Muslim Personal Law (MPL) which will also give legal consequences to marriages conducted according to the tenets of the Muslim religion. Reference to such a need is made in the draft “Muslim Marriages  Bill (MMB)”  <strong>Chapter 5</strong> which currently awaits cabinet approval. Your desire to present to Parliament an all exclusive Bill is well known and we ask you to correct this oversight.</p>
<p>The father of Islam  in South Africa Sheikh Yusuf  1626-1699 <strong>(ORDER OF THE COMPANIONS OF OR</strong> <strong>TAMBO IN GOLD)</strong> left a legacy over 300 years ago which we believe will be crowned by the granting of legal consequences for our marriages and other matters relating to Muslim Personal Law. This was also the dying wish to me  of former Minister of Justice The Honourable <strong>Dullah Omar &#8211; </strong> a wish which his comrade and friend our beloved former <strong>President  Nelson Mandela</strong> wanted to realize together in  their lifetime but prevented from achieving because of constitutional constraints. It is only now that the best legal minds in the country  has produced a Bill that has produced this landmark legislation that the wishes of Sheikh Yusuf, Dullah Omar and Nelson Mandela is within our reach. A paper by <strong>Sheikh  Dr. AK Tofffar</strong> captures these aspirations and challenges. The AL JAMA-AH Political Party call on you  Mr J.T. Radebe to take the brave step at this final stage perhaps against all precedent to make provision for a</p>
<p><strong>MUSLIM PERSONAL LAW (MPL) MATTERS SPECIAL DIVISION IN THE SUPERIOR COURTS BILL. </strong></p>
<p><strong> </strong></p>
<p>No harm will be done if  this provision is made while the (MMB) is still under consideration or any other Bills related to MPL is legislated.  We will further  take the liberty to suggest changes to the Bill before the above deadline to accommodate this and trust that the  two (2) attachments  will be of  some help. considered.</p>

Hot on the heels of  the 16 June 1976 freedom revolution on the streets of South Africa by our kids plans were set in place to free Nelson Mandela  so that he can  govern the country. The riots made very little impact on the Muslim leadership who were more concerned about &#8220;boere&#8221; desecrating mosque carpets. Free Mandela Committees mushroomed in all the townships. I received orders to mobilise the Muslim leadership and they flocked to the Bekoedratulla Hall in Cashel Avenue  at the invitation of the Muslim Students Association(MSA) to adopt a resolution calling for the release of Nelson Mandela. As hurriedly as the representatives of 75 Muslim bodies entered the Hall they left including the MJC delegation for fear of detention and MSA stalwarts were left to tell the world about this resolution. The secretary of the MJC gave me the keys to their office across the road so I could use their typewriter and photocopying facilities. Off we went to the newspapers not using St Georges Street but entrances closer to  Bree Street. St Georges Street entrance  was for whites. I included Achmat Cassiem&#8217;s name in the release call as the Qibla freedom fighters were the only other activists prepared to get involved further. My proudest moment at the time was to send  telegrams asking for the Saudi King and Brother Leader Muammar Gaddafi whose guest I was a few years earlier  to help release Mandela. This I kept quiet not to get the wrath of some of my comrades wo had issues about the monarchy. But the order was &#8220;do whatever you can&#8221; to get Muslim support.  My arrest later is another story but then comes 27 April 1994 and I am faced by the Islamic Unity Convention&#8217;s resolution &#8220;not to vote&#8221; and I am the Convention&#8217;s P.R.O.  As I stood in the line to vote I had to use my talents as a novice spin doctor to convince myself &#8220;How can I not vote&#8221;. We got Mandela  released and now we must help him govern.</p>

			<content:encoded><![CDATA[<p>The call on Muslim radio stations  by the AL JAMA-AH Political Party to Moulana Yunis Patel and Mufti A.K. Hussein to have a change of heart and support the national team and reverse their call  on Muslims to boycott the 2010 soccer event has met with a mixed response as the Alims are very influential. The Party is concerned that the boycott call will damage Muslim-African relations in South Africa as the event is positioned as an   African event and was made at the the same time that there is a fictitious Muslim  terrorist threat and a local professor is fueling tensions saying more and more Muslims are becoming terrorists in South Africa. South Africa is set to stage the best ever world cup event  and it must not be said decades later that Muslims did not help. </p>
